Can some please help me with a legal problem?

I was wondering if anyone knew if I could take legal action for my problem. My problem is that my finance is in the county jail for a fine that he missed a payment by one day. So a 72 hour bench warrant was issued. The 72 hours was up on Monday at 4pm. And the judge never made any type of court hearing and refuses to speak with me or him. What should I do? Should I hire a lawyer?
There is no more to the story except for the fact the judge doesn’t like his sister. His sister has gotten into a lot of trouble with the law.
So the judge is pretty much taking it out on him. I know that he can not do that but how can you prove it?

    You probably should hire a lawyer. If the warrant was for 72 hours and that time is up, a writ of Habeus Corpus is probably in order.

    However… I suggest you have your eyes wide open here. It sounds like he really irritated this judge, a lot more than being one day late would suggest. There may be part of the story you haven’t heard yet. Just be cautious. open4one

    Yes you should contact a lawyer. It is possible the judge is discriminating against him for some reason. Either that or they are holding him for more charges or pending charges. Take a deep breath and call a lawyer. good luck bunnicula

    Depending on when he was picked up the 72 hours might not have “been up” Monday at 4 pm. Weekends and Holidays DO NOT count. Typically the 72 hours is only an investigative hold. During that time they have to either charge the inmate with the crime they are being held on or release them. If he is on probation he has now violated his probation by not paying the fine as agreed even if he was only one day late. So in other words he may possibly looking at more time. One Sexy Jeep Girl
