family law
Jazzi asked:

Hi I’ve just completed an assignment for legal studies, where we had to pick a subject from family law and talk about whether it needs reform and so on

i did abortion in qld saying that it needs yo bre reformed as it is unclear, different in each state of Australia and that it should be a woman’s choice not the states etc

But apparently i did too much the criminal code.. said my teacher and no she keeps saying put in family law put in family law and how it affects the family etc…

does abortion come under family law or did i just make a huge mistake???

=/ hmph.

    big mistake sorry
family law describes divorce and within that
division of assets and custody of children

generally speaking family law is federal although defactos are state as the Constitution reserves marriage for the federal government and defacto isn’t marriage

destruction of fetus is purely criminal code as fetuses are not children

As above, Family Law doesn’t have anything to do with abortion. Sorry. You’d need to look at Divorce, Custody battles etc. I suppose you may (clutching at straws) be able to argue along the lines of the rights of the unborn child, the fathers right to have a say in abortion etc, that way you may be able to link it more to Family Law. But yeah. Your teacher should really have told you earlier, as soon as she knew what you were doing! I can see how you made that mistake though.
