I have a pre-existing case with my daughter mom. 6 years ago she was arrested for Prescription forgery, but the courts decide that my daughter should live with her. 6 months ago her moms life fell apart and she attempted suicide. My daughter now lives with me full time, and I am now having to go back to court because I have proof her mom is using Meth. In our previous order the judge imposed random drug screening which she passed for about 5 yrs. Do I have a right when I go back to court to have her tested still. I don’t want her to have the chance to clean her self up and lie. She needs help, and it is affecting my daughter(age 15) who is the one who found the drugs. Her momdoesn’tt know that she found them either. Please help

    You need a lawyer. Cases like this have many facets and you will blow it on your own.

    David gave the right answer - do not go into court without legal representation. The consequences of your trying to do this far outweigh any benefit you can think of…namely your daughter. Let your attorney be the one to make the argument for furthering testing.

    Consult your lawyer again for some legal action.You cannot just make a move on your own if you still have the case with your wife. Your daughter is not a child anymore,she can make her own statement by appearing on court without any prejudice of whatsoever.

    If your X is using drugs again and your daughter is living with you because she attempted suicide, I would suggest your 15 year old daughter is old enough to decide who she would rather live with. Have your atty go for full custody.
