If you do then you don't deserve even joint custody. Just because she has been abusive to you in the past does not mean she is a bad mother. Taking away her parental rights wouldn't just hurt her. It would hurt your son too. Do you love your son? It kind of sounds like you love your wallet more. Get your priorities straight! First of all, don’t use your child to punish your ex wife. Good Grief..... So, your son is not the deciding factor here...money is.. You can't use things in your past relationship in court to try to prove her an unfit mother. A judge doesn't care at this point what your marital problems were...those were resolved with your divorce..or they should have been. He will only remove custody from her if she is proven to be unfit to raise him primarily. If she's ensuring he's being cared for than you have no chance. If she is neglecting his needs educationally, medically, physically, etc.. and it can be PROVEN that she is than you have a case that a judge will listen to and decide on. That's just what it is..... If this is a money thing than I highly suggest you rethink causing such turmoil in your son's life. Now that she’s taking you back for more support you want your son? Good Grief…..
