Unless there's a house, pension, a marriage of 10+ years, a large amount of money and a bunch of kids involved, there's is zero reason why his divorced shouldn't have been final a long time ago. Maybe she won't sign the papers in hopes of reconciliation... A couple CAN and sometimes DO reconcile up until the final divorce decree is signed by the judge... 

In other words... HE is CHEATING on HIS WIFE with YOU...  Legally, the courts can find him at fault for infidelity (in a "at fault" state)...
