Mark asked:
With an impending divorce, the wife wants to take the husband’s name off the two properties they both own, so that he cannot claim it as an asset. (Understanding that liability for the loan is a different issue.) What happens if he does sign it? Will it hold in a court of law? The wife doesn’t want the husband’s future wife or stepchildren to have any part of the proceeds.

Iron Chrysalis asked: Any man who has been through a custody dispute can surely attest to the horrendous amount of gender bias and lack of proper handling of facts and rights in court.
My question is this: does anyone know “specifically” what laws family court routinely violates?
I keep hearing things like “lack of due process of law” and other things, but I’m looking for something more specific to research.
Can someone with a background in law answer this one?
It grates on my soul that these things actually do come down to “he said - she said.” These things are not proof and, as I see it, this lies at the heart of the problem. It is mind-boggling to me that my kids are being stripped from me entirely based on the biased opinions of “licensed” therapists who generate reports against me. Not one iota of proof has been put forth that I ever physically attacked my wife or made any threats to her in any form whatsoever. Yet, my children are being taken from me completely based simply on the her allegations (and boy is she mad at me for daring to take half of “her” retirement).
The system is pathetic.

Judo*Knuckle asked:
Good morning, and thank you in advance for your answers.
In California, a man has 3 children. Child A with his first and ex-wife, and children B and C with his second and current wife.
Child B has a known and documented disability. Does this factor at all into the monthly amount that he has to pay towards child A ?
I do know that if child A had the disability, the man would have to pay more towards the care of that child on a monthly basis.
Does California Family Law apply any hardship deductions to the children of the second family?
Thanks again.
It’s a recent diagnosis, within the last 6 months.
But the mother of child A knows about it…. and then proceeded to request a child support modification (extreme increase) for child A.

I need to file an Ex-parte matter in another county in California and am told that they may have to have the file in possesion to accept a Exparte order for custody. Is there a law that allows the case to start while the file is in transfer?

dolphinfury asked:
I had a trial in August 2005. Although I was the respondent, the trial was initiated by myself on my behalf. I was seeking reimbursement for a significant amount of overpaid child support. I’ve called the court clerk and was told the judge is still working on it. I feel the judge is refusing to rule because she does not want to rule on my behalf (she seemed sympathetic towards the other side). Is the judge breaking the law byr dragging her feet? Do I have any other options available?
