We have been having issues with my step daughters mother. We do not have a a big chunk of money for a large retainer fee but could easily make weekly payments. We really need someone who is willing to work with us. There is a parenting plan that was put together in 2004 the child was 8 at the time. The mother is the custodial parent and both the child and father want the plan changed giving the father custody with the mother having visitation. We do need an attorney, whether or not the father is granted custodial parent or not the plan still needs to be modified and the mother will not cooperate with us. We have documented a years’ worth of issues and there is one case with CPS against the mother. Does anyone have any good recomentions. We know children can notchoose who they live with but there has been issues with the other parent and we are in hopes of getting her into our home where there is less stress, more stabiity, and most imporantly no yelling, swearing, and hitting of the child.

Judge said no.
Custodial parent asked again 8 months later, outside of court.
Custodial parent and non-custodial parent signed an agreement allowing move-away for custodial parent, and $500 month child support for non-custodial parent.
Now, 5 years later, custodial parent is claiming that the signed contract is null and void, and wants “arrears” in child support.
Yet custodial parent should be made accountable for their infraction of the family law,as well, which was moving the child out of state,
Since it was 5 years ago, I am wondering if that move away can still be pursued in court, as kidnapping or contempt of court, or did it have to be reported at the time in order for it to have any merit?

Custodial parent approached non custodial with the move-away AND the set child support amount.
Custodial parent moved FROM California TO Nevada.

I called them and was very upset, for 8 years now I have given them everything I know, everytime I find something out. Now, they know where he is and they still haven’t done anything. Here is a little more detail. It getting close to review time and the custodial parent now lives in the same state as the non-custodial parent which was not the case with the original order. So the question is which state handles the review.

I have full custody of my grandson. My daughter has 4 hours visitation each week. Access is final so is custody. Each time I plan a holiday we have to cancel based on her visitation rights…up until recently she barely shows up for her visits. I informed her in January we were planning a trip to Euope this summer. I offered to pay her way & bring her along & she declined on 3 seperate occassions. I have now invited another family member to join us. Up untill recently she stated everything was ok & that she would not interfere with us going away. As things began to move closer & she knew I had to get his passport she disappeared thinking I needed her consent to get it! I called our lawyer & had him do a letter for us as she is homeless & I could not contact her. I have the passport. Now there is an issue with how long we will be gone…this vacation is an extended vacation as we will only get to do this once I’m sure & we want to make the most of it. As the custodial parent having the child for 10 years do I have any rights at all? This is tearing our whole family apart as my daughter is constantly creating issues, not just for me but everyone as what she does affects everyone. It is like an emotional dance of blackmail that she will not give up on. Please help!
