James asked: Okay so I have had 60/40 custody with my ex and I asked to arrange the child support due to lack of hours at my job. Well the child support misspelled my address and I never received the hearing information. My ex went and calimed she had full custody and the judge neglected to look into the 60/40 custody court order.
Now with her numbers she gave and her saying she had full custody, I am paying triple the amount and sinking fast. I called the child support services and they said they could do nothing go contact family law maybe for help….
Is there an emergency way I can vacate this order? They made it retro back to auggust so I am paying almost 4x the amount…Can I get the retro refund if I show the court order, she lied, gave false numbers and I need to stop this fast before I lose my place. I cannot afford an attorney….Please give any advice…thanks…

He pays child support when he faces jail time and now after not seeing or talking to his son for 2 years he’s threatening to take her to court for full custody. I want to find out what her rights are and his but all the search engines take me to lawyers sites. I need to find laws, statures, acts, and orders for the state of North Carolina.

She has primary custody of their 5 year old daughter and wants to fight for full custody… Thing is he pleaded not guilty and is trying to delay the court process as long as possible so that he an spend time with his daughter again. My close friend recently died. She had full custody of her daughter and lived in a different state than her ex-husband. He literally spirited the child away from the funeral, signed her out of the school she was attending and took her to live with him and his fiancee. Someone who took some law courses told me that he is not legally entitled to remove the child from her natural environment in such a sudden fashion, even if he is her biological father. She lived with her mother, grandmother, and other extended family. I’m not sure. I’d like to know what the family’s options are because my friend specifically expressed that she wanted her mother and sister to raise the child ( who is 12) and not the husband because he was irresponsible, refused to work after the divorce and never paid child support. He was several thousands in arrears. Does the family have any legal recourse, or is this a done deal since the court will favor the only living parent? Serious, knowledgeable, polite responses only please.

I have a family law issue. I am wanting to regain full custody of my children and all parties are in agreement. I current share custody with my mother and she is willing to give full custody back to me. CPS was one involved early on before the case was resolved in mediation. All that being said, if everyone is in agreement do I have to go through the court system to regain custody (modification to order) or can this be handled in mediation?

My girlfriend received 50% joint-custody for her 2 children. The father is pushing for full custody and is doing ANYTHING he can to get it. He currently lives with his girlfriend who has 3 children of her own and they have 1 together, this means if he gets full custody they will have 6 children in the household.
The court ordered that the parents get the children for a week and must be returned on Friday at 5 pm. However, since they are going to school they can be picked up from the parent taking over custody on Friday after school. The 3 yr old gets off at 11 am, the 5 yr old 3 pm. The 3 yr old gets every other Friday off, and those days fall on the fathers time and so we cannot pick him up until 5 pm.
Now my question is this: Since the court ordered that the children be picked up after school by the parent taking over custody, does my girlfriend have a chance at losing her part of custody because now the father is getting more than 50% of custody because he gets them “longer”?
Well if it matters, we live in California.

I just recently inherited a substantual amount of $ from a family member. My ex-common law wife found out about it and threatened to sue me for a peice of it, stating that she is entitled to a share. We were seperated for a long while before I inherited, I say that she is not entitled. P.S. I have full custody of our child, I told her to leave me alone or I would sue her for child support–this was just a scare tactic on my behalf–the $ is for the raising of my child and a good amount has already been put in a savings account for my child.
We are from a common law state and leagally seperated.
