Okay so I have had 60/40 custody with my ex and I asked to arrange the child support due to lack of hours at my job. Well the child support misspelled my address and I never received the hearing information. My ex went and calimed she had full custody and the judge neglected to look into the 60/40 custody court order.

Now with her numbers she gave and her saying she had full custody, I am paying triple the amount and sinking fast. I called the child support services and they said they could do nothing go contact family law maybe for help….

Is there an emergency way I can vacate this order? They made it retro back to auggust so I am paying almost 4x the amount…Can I get the retro refund if I show the court order, she lied, gave false numbers and I need to stop this fast before I lose my place. I cannot afford an attorney….Please give any advice…thanks…

Is it against the law to just leave everything family, friends, job, and move to the mountains?

Urgent Help Needed - Family law issue in South Carolina!

I should start by saying that I am in Illinois, which makes things a bit more difficult for me. My friend is in South Carolina, he’s been divorced for about 3 years, he is paying child support and is not behind on child support at all. However, he failed to show at the divorce hearing, in which he was court ordered to pay some of his ex-wife’s credit card bills, but because he didn’t go to the divorce hearing he was unaware of that until about a month ago when he got a notice to appear in court for failure to comply with the court order.

He went to court yesterday, and was held in contempt, he is now in jail, and I’m trying to find out if there’s any way that something can be worked out so he can be released. Otherwise he’ll lose his job and he’ll fall behind on his child support.

He doesn’t have an attorney, basically because he’s paying way over the amount he should be paying in child support (almost twice as much).

I have been on the phone since yesterday, trying to see if there’s anything that can be done, but the court will not talk to me, the attorneys I’ve contacted will not provide a telephone consultation. Does anyone know where I can call or perhaps some firm that will help him out?
I should also ad that this is not the first time his ex wife has taken him to court. She has taken him to court ever 3 or 4 months to increase child support or for any other petty thing she can think of.
rcbricker33 - I think you misunderstood, he didn’t get the divorce decree a month ago. He’s been divorced for about 3 years. His wife wanted the divorce, he didn’t and I know, he was stupid because he didn’t show up to the divorce hearing and he never received a divorce decree… he never bothered to find out what had happened, all he worried about was the child support, which he has been paying. A month ago, he got an order to appear in court for failing to comply to the order that was given at the time of the divorce (3 years ago). That’s when he found out that aside from the child support he had been ordered to pay some of her credit card bills as well.
Ok, one, his case is in South Carolina, that is where he lives, I’m the one who lives out of state.

Two, He’s not being charged with failure to appear… they are not holding the fact that he didn’t show up 3 years ago to the divorce hearing against him. They are holding the fact that he was court ordered to pay some of his exwife’s bills and apparently was given a time frame to do it in, since he didn’t know about it, until he got the notice to go to court for failure to comply, he didn’t pay it, and they held him in contempt. I am working with his dad to get him help, his dad is disabled and he can’t help my friend much.

His normal visitation has been 2 weeks in the summer and every other weekend (while we lived in MA). Now, that we have mentioned our intentions to her mother, she is planning vacations for her family ALL summer..including a trip out of the country. The original court agreement says his ex has to get permission from him even to leave the state, and now shes planning on leaving the country.

My Q is: is there any way to get a cout date in MA while still being in CA? She is about to be in contempt & we cant afford to fly out there to set a court date in person only to have to fly back for that court date prob a couple weeks later.. thx
