What is Texas family law on visitation for a child under the age of 3?
brdycentral asked:
I read that visitation for the father of a child under the age of 3 is that no over night stays due to the child having to be with the mother, just a couple visitations a week that last a couple of hours. The baby is 4 months old and the father has had no contact with the child and now wants contact visitation with over night stays.

I’m not a texas lawyer, but I don’t think there are any hard and fast rules. Some fathers get custody, some share custody, some get overnight visits, some only get short supervised visits if they have problems, such as substance abuse.
You can just have a consult with a local lawyer. Tell them you just want a consultation and pay the hourly rate- $150 or whatever.
But, I would guess that it depends on the particular circumstances and a local attorney could give you a good idea of what a judge would do given your set of circumstances.
Best wishes.
