The Family court system is for family issues solely. They have no jurisdiction on Federal matters. Their concern is for the child.

If you want him deported or otherwise charged for tax evasion of SS fraud, you need to notify those agencies, who will be VERY interested.

In short, he does have to obey US law, but the right authorities have to become involved.

im sorry but live in uk and he would have been tracked down and prosecuted ..sometimes wonder at usa gov laws thought they would have protected their citizens more ..that is really sad fact ..beyond belief even

Because the sole concern of Family court is the well being of the child.

Child custody and child support are issues for State courts. Immigration status is a Federal issue. State courts have no jurisdiction over immigration matters, and Federal courts have no jurisdiction over child support matters.

You should have checked this out better before you got married. He may be illegal, but the child isn’t if he was born here. Why don’t you take custody & ship your ex back to where he came from?
